Session 1: Artificial Intelligence in International Arbitration
The term Artificial Intelligence (AI) refers to the simulation of human intelligence applied to objects. AI is a branch of computer science, utilized mainly in engineering trying to make computer, programs or machines thinking on their own with the purpose to help humans in analysis and study. This session discussed the possible use of Artificial Intelligence in arbitration proceedings. According to speakers’opinions, AI can only be used in establishing arbitration proceeding, studying legal information, analyzing cases comparing to other similar disputes, providing benchmarks for arbitrators and giving execution to contracts. However, Artificial Intelligence is not able to replace humans as arbitrators yet.
Session 3: Challenge of arbitrators: New trends
Arbitration is considered a possible matter. Parties are entitled to challenge arbitrator in case the latter is not acting impartially and independently or if the arbitrator does not meet the requirements set by parties in the arbitration agreement. The challenge is brought to the court at the place of the seat of arbitration, and it could result in three different decisions: removal of the arbitrator, confirmation or the arbitrator can decide to withdraw itself. The lack of impartiality and independence or the requirements could also lead to the challenge of the award. This session provided on one hand the point of view of the courts in Thailand, Mainland China on the challenges, on the other the one from counsels.
Session 5: The relationship between domestic lawyers and International Arbitration
This session discussed the role of lawyers in an international arbitration proceeding. The speaker from the Singapore International Arbitration Centre (SIAC) provided an insight into the centre’s work and his view on the interaction between domestic lawyers and foreign registered lawyers. Both these categories can coexist and work together in providing advice on arbitration. SIAC’s speakers provided also suggestions for lawyers who want to develop their knowledge and skills on international arbitration.
