Insight !! Examine With THAC The Procurement For Government Contract And Dispute Resolution That The Entrepreneur Should Know.
On 29th October 2020, Thailand Arbitration Center (THAC), led by Mr. Pasit Asawawattanaporn, THAC Managing Director, held the seminar on the topic “Examine government contract and Alternative Dispute Resolution in administration case” at Benjasiri ballroom 3 Marriot Hotel, Bangkok, aiming for entrepreneurs, contact managers and all attendees to gain utmost benefit regarding government contract and Alternative Dispute Resolution, including awareness of frequent and practical problems on procurement and services.

In this seminar on the topic “Examine government contract and Alternative Dispute Resolution in administration”, all attendees have learned and understood the basic principle of the regulation related to the responsibility of entrepreneurs and contact managers. This seminar also introduced work guidelines that are consistent with the Ministry of Finance’s regulation related to Government Procurement and Supplies Management and frequent problems and solutions on procurement and contract management. In addition to these, arbitration in procurement is also explored in this seminar.
Thailand Arbitration Center invited experts such as Mr. Phuwadon Phuboontoem, Director of Special Audit Office, State Audit Office of the Kingdom of Thailand; Mr. Samart Sangrin, the Legal Officer, Public Procurement Division, the Comptroller General’s Department; Mr.Marwin Yamkate, Senior Expert Public Prosecutor, Department of Civil Dispute Settlement and Arbitration; and Mr. Akanit Samitapintu, Head of Purchasing & Supply Chain Management Association of Thailand, to explain government contracts and Alternative Dispute Resolution, such as arbitration and mediation. It highlighted remarks and common mistakes in drafting government contracts and sharing direct experiences in legal proceedings involving government contracts. This was including an application of an arbitration process and work guidelines that are consistent with the Ministry of Finance’s regulation related to Government Procurement and Supplies Management
Moreover, Mr. Phuwadon Phuboontoem mentioned that “as a Special Audit” from the State Audit Office of the Kingdom of Thailand, he considered that this seminar was beneficial especially for related procurement officers since at the very least, an awareness in process of procurement is in itself a precaution. Ignorance tends to lead to more mistakes, which cause much more damage than we could be expected. At least, if we know, then we will try to be compliant as there are many regulations related to government procurement that must be studied. Furthermore, incompliance with the procurement process is not just a disciplinary offense; it is also related to criminal law in some severe cases. As such, the attendees have surely benefit greatly from attending this seminar.
