Thailand Arbitration Center Rules on Small Claims Arbitration
An alternative resolution by the arbitration may be perceived as though it can only use between businesses. On the contrary, any individual or SME business can resolve conflict with the arbitration. As the arbitration also has rules for Small Claims Arbitration.
Small Claims is the dispute where the claimed amount is less or equal to 35 million baht. The Rule is significant as there will only be a sole arbitrator and determined mainly on a document basis. The Arbitral Tribunal might call for witnesses or experts if they deemed appropriate.
Additionally, the arbitrator in Small Claims must conclude and issue the Award within 120 days from the first meeting with the disputing party to determine the proceeding framework. Unless it is deemed necessary, the arbitrator could extend the issuing period for not over 60 days. The whole proceeding will not be over 180 days. It can be seen that the duration of the arbitration proceeding is processing at a much faster rate comparing to the court proceeding since the court could not determine an exact duration (read Thailand Arbitration Center Rules on Small Claims Arbitration)
