
What is mediation?

Did you know that alternative dispute resolution is not just arbitration? Mediation is also one of the alternative dispute resolutions. The difference is that mediation will not be concluded as an award and will not specify an exact liable person as clearly as the arbitration.
Mediation is a resolution in which both parties are agreed upon the appointed mediator, which could be one person or several people. The mediator will settle the dispute and act on behalf of both parties to amicably settle; however, the mediator cannot decide upon the dispute.
Mediation is normally favored before submitting to arbitrations. Mediation is a mechanism not intended to judge but to achieve an understanding, consider each other, and come to an amicable resolution. Mediation also easier, more convenient, faster, and friendlier. No need to worry that there will be no contract performance once the mediation is completed. For mediation proceeded by THAC, THAC will issue a mediated agreement that can be enforceable, similarly to arbitration proceedings. The mediated agreement can even turn to an award,
